BeawIT Privacy Policy

1. About this Privacy Policy

The present document, named Privacy Policy, contains information regarding the management by BeawIT Technologies Inc. (hereinafter “BeawIT”) of Users' data.


BeawIT is committed to protecting the privacy of the Users: the privacy of the Users is BeawIT's top concern. This Privacy Policy applies to data collected by BeawIT through its Websites and services, as well as its offline support services. It does not apply to those BeawIT sites and services that do not display or link to this Policy or that have their own Privacy Policies.


Personal data of the User—that the User will provide to BeawIT when registering to the Service—will be used by BeawIT (and, whenever needed, communicated to thirds), in conformity with the applicable law, and in particular with the principles set forth in the Italian legislative Decree n. 196 issued on June 30th 2003 (Code on the protection of personal data), as amended.


2. Collector and User of User's Personal Information

The collector and user of User's personal information is BeawIT, with registered office in Vancouver, WA 2010 E 9th St, in person of its legal representative, who will be the recipient of the communications pursuant to Article 7 of the Code on the protection of personal data, as well as of any other request of information regarding the conditions of the collection and the use of Users' personal data. Such communications shall be sent to privacy@beawit.net


3. Conditions of the Collection and Use of User's Personal Information

BeawIT warrants that the User's personal information collected and used by BeawIT will not include, directly or indirectly, matters regarding sensitive data pursuant to Articles 4, lett. d), and 26 of the Italian Legislative Decree n. 196 issued on June 30th 2003.


4. Collection of the User's Personal Information

At some BeawIT sites, BeawIT may ask the User to provide personal information, such as e-mail address, name, home or work address, or telephone number. BeawIT may also collect demographic information, such as age, gender, and preferences. If the User chooses to make a purchase or sign up for a Paid Service, BeawIT will ask for additional information, such as credit card number and billing address, in order to create a BeawIT billing account.


In order to access some BeawIT services, the User will be asked to sign in with a user ID and password, which BeawIT refer to as User's access credentials. The User can use the same credentials to sign in to many different BeawIT sites and services, as well as those of selected BeawIT partners. By signing in on one BeawIT site or service, the User may be automatically signed into other BeawIT sites and services. Some services may require added security, and in these cases, the User may be asked to create an additional security key.


BeawIT may collect information about the User's interaction with BeawIT sites and services. For example, BeawIT may use website analytics tools on a BeawIT site to retrieve information from the User's browser, including the site the User came from, the search engine(s) and the keywords the User used to find the BeawIT site, the pages the User views within the BeawIT site, and the User's browser add-ons. BeawIT may also use technologies, such as cookies, to collect information about the pages the User views, the links he/she clicks and other actions the User takes on BeawIT sites and services. Additionally, BeawIT collects certain standard information that the User's browser sends to every website the User visits, such as IP address, browser type and language, access times and referring Website addresses.


In order to offer to the User a more consistent and personalized experience in his/her interactions with BeawIT, information collected through one BeawIT service may be combined with information obtained through other BeawIT services.


5. Use of the User's Personal Information

BeawIT collects and uses the User's personal information to operate and improve its sites and services. These uses may include providing the User with more effective User service; making the sites or services easier to use by eliminating the need for the User to repeatedly enter the same information; performing research and analysis aimed at improving BeawIT services and technologies; and displaying content that is customized to the User's interests and preferences.


BeawIT may also use the User's personal information to communicate with the User. BeawIT may send certain mandatory service communications such as billing reminders, information on technical service issues and security announcements. In relation to some services, BeawIT may send to the User periodic letters that are considered part of the service. BeawIT may also occasionally send to the User promotional mailings to inform him/her of other services available from BeawIT.


Personal information collected on BeawIT sites and services may be stored and processed in Italy or any other country in which BeawIT or its subsidiaries or service providers maintain facilities.


6. Sharing of the User's Personal Information

Except as described in this Policy, BeawIT will not disclose the User's personal information outside of BeawIT and its controlled subsidiaries without the User's consent. BeawIT does not share the User's contact information with third parties for marketing purposes.


Some BeawIT services may be co-branded and offered in conjunction with another company. If the User registers for or uses such services, both BeawIT and the other company may receive information collected in conjunction with the co-branded services.


BeawIT occasionally hires other companies to provide limited services on its behalf, such as handling the processing and delivery of mailings, providing User support, hosting websites, processing transactions, or performing statistical analysis of its services. Those service providers will be permitted to obtain only the personal information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose. However, for credit card processing, BeawIT's fraud detection vendors may use aggregate data to help improve their service. This helps them more accurately detect fraudulent uses of credit cards. BeawIT may access or disclose information about the User, including the content of the User's communications, in order to:


comply with the law or respond to lawful requests or legal process;

protect the rights or property of BeawIT or its Users, including the enforcement of the agreements or policies governing the User's use of the services; or

act on a good faith belief that such access or disclosure is necessary to protect the personal safety of BeawIT employees, Users or the BeawIT.

7. Accessing the User's Personal Information

The User may have the ability to view or edit his/her personal information online. In order to help prevent the User's personal information from being viewed by others, the User will be required to sign in with his/her credentials (user ID and password). The User can access and update his/her profile on BeawIT by visiting the online service he/she is using.


8. Security of the User's Personal Information

BeawIT is committed to protecting the security of the User's personal information. BeawIT uses a variety of security technologies and procedures to help protect the User's personal information from unauthorized access, use, or disclosure. For example, BeawIT stores the personal information the User provides on computer systems with limited access, which are located in controlled facilities. When BeawIT transmits highly confidential information (such as a credit card number or password) over the Internet, BeawIT protects it through the use of encryption, such as the Secure Socket Layer (SSL) protocol.


If a password is used to help protect the User's accounts and personal information, it is the User's responsibility to keep his/her password confidential. The User shall not share this information with anyone. If the User is sharing a computer with anyone, he/she should always log out before leaving a site or service to protect access to his/her information from subsequent users. If the User does not log out before leaving a site or service, BeawIT shall not be liable for, and in relation to, any abuse committed by thirds.


9. Use of Cookies

BeawIT Websites use "cookies" to enable the User to sign in to BeawIT's services and to help personalize his/her online experience. A cookie is a small text file that is placed on the User's hard disk by a web page. Cookies contain information that can later be read by a web page in the domain that issued the cookie to the User. Cookies cannot be used to run programs or deliver viruses to the User's computer.


One of the primary purposes of cookies is to store the User preferences and other information on his/her computer in order to save him/her time by eliminating the need to repeatedly enter the same information and to display his/her personalized content on later visits to BeawIT sites. BeawIT Websites also use cookies as described in the Collection of the User's Information section of this Privacy Policy.


When the User signs in to a BeawIT site, BeawIT store his/her unique user ID, and the time the User signed in, in an encrypted cookie on his/her hard disk. This cookie allows the User to move from page to page at the site without having to sign in again on each page. When the User signs out, these cookies are deleted from his/her computer. BeawIT also uses cookies to improve the sign-in experience. For example, the User's user ID may be stored in a cookie that will remain on his/her computer after the User signs out. This cookie allows the User's user ID to be pre-populated, so that he/she will only need to type the password the next time he/she signs in.


The User has the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but the user can usually modify his/her browser setting to decline cookies if he/she prefers. If the User chooses to decline cookies, he/she may not be able to sign in or use other interactive features of BeawIT sites and services that depend on cookies.


If the User chooses to accept cookies, he/she also has the ability to later delete cookies that he/she has accepted. If the User chooses to delete cookies, any settings and preferences controlled by those cookies will be deleted and may need to be recreated.


10. Log Information

When the User accesses BeawIT services, BeawIT's servers automatically record information that the User's browser sends whenever he/she visits a website. These server logs may include information such as the User's web request, Internet Protocol address, browser type, browser language and the date and time of the request.


11. Anti-Spam Policy

BeawIT has a strict Anti-Spam Policy prohibiting the use of BeawIT messaging services to send spam. BeawIT prohibits the use of the Services in any manner associated with the transmission, distribution or delivery of any unsolicited bulk or unsolicited commercial e-mail ("Spam"). The User may not use any Services to send Spam. The User also may not deliver Spam or cause Spam to be delivered to any of BeawIT's Services or Users.


In addition, e-mail sent, or caused to be sent, to or through the Services may not:


employ any technique to otherwise misrepresent, hide or obscure any information in identifying the point of origin or the transmission path;

contain false or misleading information in the subject line or otherwise contain false or misleading content;

fail to comply with additional technical standards described below; or

otherwise violate the applicable Terms and Conditions of Service (”TACOS”) for the BeawIT's Services.

BeawIT does not authorize the harvesting, mining or collection of e-mail addresses or other information from or through the Services.


BeawIT does not permit or authorize any attempt to use the Services in a manner that could damage, disable, overburden or impair any aspect of any of the Services, or that could interfere with any other party's use and enjoyment of any Service.


If BeawIT believes that unauthorized or improper use is being made of any Service, it may, without notice, take such action as it, in its sole discretion, deems appropriate, including blocking messages from a particular User. BeawIT may immediately terminate any account on any Service which it determines, in its sole discretion, is transmitting or is otherwise connected with any e-mail that violates this policy.


Nothing in this policy is intended to grant any right to transmit or send e-mail to, or through, the Services.


Failure to enforce this policy, even partially, in every instance does not amount to a waiver of BeawIT's rights.


Unauthorized use of the Services in connection with the transmission of unsolicited e-mail, including the transmission of e-mail in violation of this policy, may result in civil, criminal, or administrative penalties against the sender and those assisting the sender.


12. Right to Give Consent and Consequences of Refusing the Consent

The User has the freedom to choose whether to provide or not his/her personal information to BeawIT. Nevertheless, if the User does not provide to BeawIT, even partially, his/her personal information, which is indicated as necessary for the provision of Services by BeawIT, as indicated in the TACOS, it will be impossible for BeawIT to provide the Services. If the User does not provide to BeawIT his/her personal information which is not indicated as necessary for the provision of Services by BeawIT, the provision of the Services will not be affected. The User also has the freedom to choose whether to provide or not his/her consent to the collection of his/her personal information in relation to the web navigation, made through the use of cookies or other technologies. Nevertheless, if the User does not provide consent, it will be impossible for BeawIT to provide the Services that depend on cookies.


13. Rights of the User

Pursuant to Article 7 of the legislative Decree n. 196 issued on June 30th 2003 (Rights of the User) the User has the right to know whether BeawIT handles his/her personal information, even if not yet registered, as well as the right to receive communications containing such personal information.


The User also has the right to ask for and obtain indications concerning:


the origin of the personal information;

the aim of the collection and of the use of his/her personal information;

the procedures governing the collection and of the use of his/her personal information;

the collector and the user of his/her personal information and the person responsible for such collection and use;

the persons to whom his/her personal information may be communicated.

The User also has the right to ask for and obtain:


the adjournment, the modification or the integration of his/her personal information;

the cancellation, the transformation into anonymous information or the block of the personal information which is collected and used in violation of the law, included the personal information which is not necessary to store in the light of the aims for which it has been collected and used;

the confirmation that the procedures under a) and b) have been communicated to the persons who have received and shared such personal information, except for the case that such communication is impossible or requires an effort which is not proportioned with respect to the protected right.

The User also has the right to oppose, in total or in part:


for legitimate reasons, the collection and the use of his/her personal information, even if relevant with respect to the aim of the collection and use;

the collection and the use of his/her personal information, if aimed at sending BeawITity materials.

14. Changes to This Privacy Policy

BeawIT will occasionally update this Privacy Policy to reflect changes in its Services and User feedback. If there are material changes to this Policy or in how BeawIT will use the user's personal information, BeawIT will notify the User either by prominently posting a notice of such changes prior to implementing the change or by directly sending the User a notification. BeawIT encourages the User to periodically review this Policy to be informed of how BeawIT is protecting his/her information.
